These Terms of Service (“Terms”) govern your use of the Kottmyer Athletics website, KA Momentum application, coaching services, and related products and services provided by Kottmyer Athletics LLC (“Kottmyer Athletics,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms.

Eligibility and Accounts

You are responsible for providing accurate account information and maintaining the confidentiality of your login credentials. You are responsible for activity occurring through your account.

Our services are not directed to children under 13. Users under 18 should use our services only with the involvement and permission of a parent or legal guardian where required.

Fitness, Nutrition, and Wellness Disclaimer

Kottmyer Athletics and KA Momentum provide fitness, nutrition, accountability, educational, and coaching services. These services are not medical care and are not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition.

Information provided through KA Momentum or by a coach is not a substitute for advice from a physician or other qualified healthcare professional. You should consult an appropriate healthcare professional before beginning or materially changing an exercise, nutrition, or wellness program, particularly if you have a medical condition, injury, take medication, are pregnant, or have other health concerns.

You are responsible for exercising within your own abilities and limitations.

No Guaranteed Results

Individual results vary. Kottmyer Athletics does not guarantee specific weight loss, muscle gain, strength, fitness, health, or other results. Results depend on numerous factors, including individual circumstances, consistency, adherence, lifestyle, and factors outside our control.

KA Momentum

KA Momentum may provide features including workout programming, nutrition tracking, progress tracking, check-ins, accountability tools, coaching communication, educational information, and other fitness or wellness functionality.

Features may be modified, added, removed, interrupted, or updated as the service evolves. During beta or testing periods, users may encounter bugs, incomplete functionality, service interruptions, or other technical issues.

User Responsibilities

You agree to use Kottmyer Athletics and KA Momentum lawfully and responsibly. You may not attempt to interfere with the operation or security of our services, gain unauthorized access to accounts or systems, misuse another person's account, or use the service for unlawful purposes.

You are responsible for the accuracy of information you enter into KA Momentum or provide to your coach.

Coaching Services

Specific coaching services, communication frequency, programming, pricing, and other benefits may depend on the coaching plan or agreement selected by the client.

Coaching recommendations may be adjusted based on progress, client feedback, available information, and the coach's professional judgment.

Subscriptions, Payments, and Cancellation

Certain Kottmyer Athletics or KA Momentum services may require payment or a recurring subscription. Applicable prices, billing frequency, promotional terms, renewal terms, and other purchase information will be presented before purchase.

Unless otherwise stated at purchase, cancellation stops future renewal and does not automatically provide a refund for a period already purchased or partially used. Any refunds provided are subject to applicable law and the terms presented at purchase.

Third-Party Services

KA Momentum may interact with or link to third-party services, platforms, devices, or data providers. We are not responsible for the availability, accuracy, security, or independent practices of third-party services.

Intellectual Property

KA Momentum, Kottmyer Athletics branding, logos, designs, software, original content, and other proprietary materials are owned by Kottmyer Athletics LLC or its applicable licensors and may not be copied, reproduced, distributed, or commercially exploited without authorization except as permitted by law.

Privacy

Your use of our services is also subject to our Privacy Policy. The Privacy Policy explains how Kottmyer Athletics collects, uses, and protects information associated with our services.

Service Availability

We work to provide reliable services but do not guarantee uninterrupted or error-free operation. Services may occasionally be unavailable because of maintenance, technical problems, updates, third-party outages, or circumstances outside our reasonable control.

Termination

We may suspend or terminate access to our services when reasonably necessary because of violations of these Terms, misuse of the service, security concerns, unlawful activity, or nonpayment of applicable fees.

Users may discontinue use of the services at any time, subject to applicable subscription and cancellation terms.

Limitation of Liability

To the maximum extent permitted by applicable law, Kottmyer Athletics LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use our services.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Changes to These Terms

We may update these Terms as our services, features, or legal requirements change. When material changes are made, we will update the effective date and provide additional notice where required by law.

Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where applicable law requires otherwise.
